Will the murder trial of Andrew Gallo move out of Orange County? This is the question that many Los Angeles criminal defense attorneys have on their minds. The man, who has been accused of killing Angels pitcher Nick Adenhart, might be hated by some in the OC community, but does that mean it's impossible to find an impartial jury?
The Orange County Register reports that prosecutors have argued in a court brief that it would be possible to find impartial local jurors in Orange County and that a change of venue in this case does not meet the legal requirement of establishing that local jurors cannot be impartial. Defense attorneys disagree and have filed a motion to move Andrew Gallo's trial outside the OC.
The defendant has been accused of killing the Anaheim Angels pitcher Nick Adenhart and two other passengers in a 2009 drunk driving accident. A fourth person in the vehicle was reportedly seriously injured after the accident. Defense attorneys assert that the news coverage surrounding Nick Adenhart's death has been "pervasive, continuous, and hostile"
Andrew Gallo, of San Gabriel, has pleaded not guilty to three murder charges. If convicted of all the murder counts, he could be sentenced to 50 years to life in prison. Defense attorneys are doing everything that they can to defend the man of such extreme charges from an alleged drunk driving collision, starting with filing the motion to change the location of the hearing. Superior Court Judge Richard F. Toohey has scheduled a July 16 hearing on the motion for a change of venue. The defendant's trial is set to start in August.
